Terms & Conditions

Private Aircraft Charter Brokerage · Version October 2026

These Terms & Conditions form an integral part of every Flight Contract issued by ANONA AS for private aircraft charter. ANONA AS acts as charter broker. The operating air carrier is responsible for the operation of the aircraft and the performance of the flight.

1. Scope and Acceptance

  1. 1.1

These Terms apply to all quotes, bookings and Charters arranged by Anona, whether or not they are physically attached to the Flight Contract, and to all services Anona provides in connection with a Charter.

  2. 1.2

The Customer accepts these Terms by signing or electronically accepting the Flight Contract, by confirming a booking in writing, or by making any payment for the Charter, whichever occurs first.

  3. 1.3

Any terms and conditions of the Customer, including terms in purchase orders or correspondence, do not apply unless Anona has expressly accepted them in writing.

  4. 1.4

A person who books on behalf of a company, another person or a group of Passengers warrants that he or she is authorised to do so, and shall ensure that all Passengers are informed of and comply with these Terms. The person making the booking and the entity on whose behalf the booking is made are jointly and severally liable for payment.

2. Definitions

  1. 2.1

“Anona” means ANONA AS, Norwegian organisation and VAT no. 927 941 058. “Customer” or “Charterer” means the person, company or other entity that enters into the Flight Contract with Anona. “Passenger” means any person travelling or intending to travel on a Charter. “Lead Passenger” means the Passenger named by the Customer as the primary contact during the Charter.

  2. 2.2

“Carrier” means the licensed air carrier holding the Air Operator Certificate (AOC) under which the flight is operated. “Aircraft” means the aircraft identified in the Flight Contract or any substitute arranged under clause 15. “Flight Contract” means the booking confirmation or charter contract issued by Anona for the relevant Charter. “Charter” means the flight or flights described in the Flight Contract, and “Leg” means each individual flight sector.

  3. 2.3

“Charter Price” means the total price for the Charter stated in the Flight Contract, excluding additional charges under clause 7. “Business Day” means a day on which banks are open for general business in Oslo. “Consumer” means a natural person acting mainly for purposes outside his or her trade, business or profession. “Terms” means these Terms & Conditions.

3. Anona’s Role as Charter Broker

  1. 3.1

The Customer appoints Anona to arrange the Charter on the Customer’s behalf. Anona acts solely as charter broker and agent for the Customer. Anona does not own, operate, maintain or crew the Aircraft and does not act as an air carrier, contracting carrier or tour operator.

  2. 3.2

Where operationally required, the Customer authorises Anona to enter into the charter agreement with the Carrier in Anona’s own name, for the account and on behalf of the Customer. This does not make Anona a party to the contract of carriage, which is between the Carrier and the Customer and Passengers.

  3. 3.3

The Carrier has exclusive operational control and sole responsibility for the safe and lawful operation of the flight, including all decisions concerning the Aircraft, crew, weather, routing, payload, fuel, safety, security and regulatory compliance.

  4. 3.4

Carriage by air is subject to the Carrier’s Conditions of Carriage and/or General Conditions, which are available on request. Anona’s remuneration may be included in the Charter Price and is not shown separately unless required by law.

4. Selection of the Carrier

  1. 4.1

Anona will arrange Charters only with Carriers that, to the best of Anona’s knowledge at the time of booking, hold a valid AOC and operating licence for the type of operation and maintain insurance at least as required by Regulation (EC) No 785/2004 or equivalent applicable law.

  2. 4.2

Anona does not audit the Carrier and gives no warranty regarding the Carrier’s operations beyond the exercise of reasonable care and skill in its selection.

5. Quotes, Booking and Contract Formation

  1. 5.1

Quotes are non-binding and remain valid only for the period stated in the quote, or if no period is stated, for 24 hours. All quotes are subject to aircraft and crew availability, slots, PPR, parking, traffic rights, permits and operational feasibility at the time of booking.

  2. 5.2

A Charter is confirmed only when Anona has issued a written Flight Contract and any payment due on confirmation has been received, unless otherwise expressly agreed in writing.

  3. 5.3

The Customer shall check the Flight Contract upon receipt and notify Anona in writing without delay of any errors in dates, times, airports, Passenger details or other booking information. Times stated are local times unless otherwise indicated.

6. Order of Precedence

  1. 6.1

In case of conflict, the following order applies to the commercial terms of a Charter: (i) the Flight Contract, (ii) these Terms. For matters concerning the operation of the flight and carriage by air, the Carrier’s Conditions of Carriage prevail to the extent required by applicable law.

  2. 6.2

Where the Flight Contract is silent on a matter, these Terms apply in full, including the default provisions on payment (clause 8), cancellation (clause 9) and check-in (clause 13).

7. Price, Taxes and Additional Charges

  1. 7.1

The Charter Price includes only the services expressly stated in the Flight Contract. Prices are stated in the currency of the Flight Contract and are exclusive of VAT unless otherwise stated. VAT and other taxes are charged where applicable.

  2. 7.2

Unless expressly included, the following may be charged to the Customer in addition to the Charter Price: de-icing and anti-icing; extended airport, handling or customs opening hours; special handling; additional or special catering; WiFi and satellite communication usage; landing permits and traffic rights obtained at short notice; security services; VIP lounges and terminals; customs and immigration charges; cleaning arising from pets, smoking or excessive soiling; crew overnight costs arising from changes requested by the Customer; and other costs arising from the operation of the Charter.

  3. 7.3

If, after confirmation, the Carrier passes on an increase in taxes, government charges, airport fees, security costs, fuel surcharges or similar direct operating costs attributable to the Charter, Anona may pass on the documented increase to the Customer to the extent permitted by applicable law.

  4. 7.4

Additional charges incurred in a currency other than that of the Flight Contract are converted at the exchange rate applied by Anona’s bank on the date of invoicing.

8. Payment

  1. 8.1

Payment shall be made in the amount, currency and by the deadline stated in the Flight Contract or invoice. If no deadline is stated, the Charter Price is due within three (3) Business Days of confirmation and in any event no later than 72 hours before the first scheduled departure. For bookings made less than 72 hours before departure, payment is due immediately.

  2. 8.2

Cleared funds must be received by Anona before the flight is released, unless otherwise expressly agreed in writing. Payment is made only when the full amount is credited to Anona’s account. The Customer bears all bank, transfer and card charges.

  3. 8.3

Post-flight charges. Charges that can only be determined after the flight, including WiFi usage, additional catering and bar consumption, de-icing, extended handling and other usage-based or operational costs, will be invoiced after completion of the Charter and are payable within ten (10) days of the invoice date. These charges are payable even though the flight was released before they were invoiced.

  4. 8.4

If payment is not received when due, Anona may suspend performance, withhold release of the flight, or by written notice treat the booking as cancelled by the Customer, in which case the applicable cancellation charges under clause 9 become immediately due.

  5. 8.5

Overdue amounts accrue interest at the rate set under the Norwegian Late Payment Interest Act (forsinkelsesrenteloven) from the due date until payment is received. The Customer shall also pay reasonable collection costs, including statutory reminder and collection fees.

  6. 8.6

The Customer may not withhold or set off any amount against sums owed to Anona. Where payment is made by card, the Customer shall not initiate a chargeback for services performed or for charges validly due under these Terms. An unjustified chargeback constitutes a breach of these Terms, and the amount reversed, together with related costs, remains due.

9. Cancellation by the Customer

  1. 9.1

A cancellation is effective only when received by Anona in writing. Cancellation charges are as stated in the Flight Contract. Where the Flight Contract does not state cancellation charges, the following charges apply, calculated as a percentage of the total Charter Price and based on the time of receipt of the written cancellation relative to the first scheduled departure:

Time of cancellation before first scheduled departureCharge
From confirmation until 14 days before departure25 %
    13 days to 7 days before departure50 %
Less than 7 days and more than 72 hours before departure75 %
72 hours or less before departure, or no-show100 %
  2. 9.2

Where the Carrier applies stricter cancellation conditions, or where non-refundable positioning costs, permits, catering or other committed third-party costs have been incurred, these may be charged to the Customer in addition to, or instead of, the above charges, provided they were disclosed in or incorporated into the Flight Contract.

  3. 9.3

Cancellation of one or more Legs of a multi-Leg Charter may result in charges up to the full Charter Price where the Carrier’s price is based on the complete itinerary.

  4. 9.4

A Passenger who does not present for departure, or who is refused carriage due to missing or invalid documents, intoxication, misconduct or any other reason attributable to the Passenger, is treated as a no-show and the Charter Price remains payable in full.

  5. 9.5

Cancellation charges become due immediately upon cancellation and may be set off against any amount already paid. Any balance due to the Customer will be refunded within thirty (30) days.

10. Changes Requested by the Customer

  1. 10.1

Any request to change the date, time, routing, airport, Aircraft, number of Passengers or other booking details must be made in writing and is subject to Carrier approval and operational feasibility. Anona does not guarantee that a change can be accommodated.

  2. 10.2

Additional costs resulting from an approved change, including repositioning, crew duty extensions, overnight costs and new permits, are payable by the Customer and, where requested, before operation.

  3. 10.3

If a requested change cannot be accommodated and the Customer elects not to proceed with the confirmed Charter, the cancellation terms in clause 9 apply.

  4. 10.4

Delays requested or caused by the Customer or a Passenger may lead to waiting charges and costs. If a delay causes the crew to exceed applicable flight and duty time limitations or causes slots, permits or airport opening hours to expire, the Carrier may be unable to operate. The Customer bears all resulting costs, and any Leg that cannot be performed for this reason is treated as cancelled by the Customer.

11. Passengers, Travel Documents and Lead Passenger

  1. 11.1

The Customer shall provide complete and accurate Passenger information, including full names as stated in travel documents, dates of birth, nationalities and passport or ID details, no later than 48 hours before departure or such earlier time as Anona or the Carrier may require.

  2. 11.2

The Customer is responsible for ensuring that every Passenger holds a valid passport or ID document, visas, ETA, ESTA or equivalent authorisations, health documentation and any other documents required for the journey, including for transit and return. Passengers must carry these documents on board.

  3. 11.3

Minors travelling without a parent or legal guardian, Passengers with reduced mobility, and Passengers who are pregnant or have medical conditions that may affect their fitness to fly must be notified to Anona at the time of booking. The Carrier may require consent forms or medical clearance and may refuse carriage where its requirements are not met.

  4. 11.4

The Customer shall appoint a Lead Passenger and provide a mobile telephone number at which the Lead Passenger can be reached before and during the Charter. Operational messages given to the Lead Passenger are deemed given to the Customer.

  5. 11.5

The Customer bears all costs, fines and consequences arising from missing, invalid or inaccurate documentation or Passenger information, including denied boarding, denied entry, removal and return transportation.

12. Conduct on Board

  1. 12.1

Passengers must comply with all reasonable instructions from the Carrier and crew. The captain has final authority on board.

  2. 12.2

The Carrier may refuse carriage to, or remove from the Aircraft, any Passenger whose conduct, condition, intoxication or documentation may compromise safety, security, legality or the orderly operation of the flight. Such refusal does not entitle the Customer to a refund.

  3. 12.3

Smoking, including electronic cigarettes, is prohibited on board unless expressly permitted by the Carrier. The use or carriage of illegal substances is prohibited. Alcohol is served at the discretion of the crew.

  4. 12.4

The Customer is liable for damage to the Aircraft, its interior and equipment caused by any Passenger, including the costs of repair, special cleaning and documented loss of use of the Aircraft.

13. Check-in, Baggage and Dangerous Goods

  1. 13.1

Passengers and baggage must be present at the meeting point and time stated in the Flight Contract or flight brief. If no time is stated, Passengers shall be present at the designated FBO, private terminal or meeting point no later than thirty (30) minutes before scheduled departure.

  2. 13.2

The Carrier is not obliged to delay a flight for late Passengers or baggage. Any delay accepted by the Carrier is at the Customer’s cost and subject to clause 10.4.

  3. 13.3

All baggage is subject to Aircraft-specific weight, size, loading and balance limitations. The Customer shall inform Anona of oversized or special baggage, such as golf bags, skis, bicycles and musical instruments, at the time of booking. The Carrier and crew have final authority over what may be carried and how it is loaded. Excess or unsuitable baggage may be refused.

  4. 13.4

The Customer shall ensure that no prohibited, restricted or dangerous goods are presented for carriage. Firearms, ammunition and other weapons may only be carried with the Carrier’s prior written approval and all required permits.

  5. 13.5

Passengers and baggage are subject to security screening and customs and immigration controls as required by law.

14. Pets

  1. 14.1

Pets are accepted only with prior written approval from the Carrier and subject to the Carrier’s requirements and applicable laws, including import and transit rules. The Customer is responsible for all required pet documentation, vaccinations, health certificates and related charges.

  2. 14.2

Pets must be kept under control at all times. Cleaning and damage caused by pets are charged to the Customer. The consequences of refused carriage or entry due to non-compliant pet documentation are borne by the Customer.

15. Aircraft or Carrier Substitution

  1. 15.1

If the confirmed Aircraft or Carrier becomes unavailable for any reason, Anona may arrange a suitable substitute Carrier and/or aircraft of a comparable or higher category. A substitution that does not materially increase the price or materially reduce the agreed service level does not require the Customer’s approval.

  2. 15.2

A substitution that results in a material price increase or a material reduction in the agreed service level requires the Customer’s approval. If the Customer declines such a substitute, or if no suitable substitute is available, the Customer is entitled to a refund of amounts paid for the unperformed portion of the Charter, less non-refundable costs properly incurred for services already performed, to the extent permitted by applicable law.

  3. 15.3

A refund under this clause is the Customer’s sole remedy against Anona for the unavailability of the Aircraft or Carrier, unless the unavailability was caused by Anona’s negligence.

16. Operational Changes, Delays and Diversions

  1. 16.1

The Carrier and the captain have final authority over all operational and safety decisions. Flights may be delayed, rerouted, diverted, rescheduled or operated to or from an alternative airport due to weather, safety, airport restrictions, air traffic control, technical matters, regulatory requirements or other operational circumstances.

  2. 16.2

Additional third-party or operating costs arising from a diversion or the use of an alternative airport, and not caused by Anona, may be charged to the Customer where permitted by applicable law. Anona will use reasonable efforts to assist with alternative arrangements but does not guarantee schedules or connections.

17. Empty Legs and One-Way Opportunities

  1. 17.1

Where a flight is sold as an empty leg, repositioning sector or other opportunity dependent on another aircraft movement, the Customer acknowledges that the flight is subject to a higher risk of schedule change or cancellation, including at short notice.

  2. 17.2

If an empty leg is cancelled or rescheduled because of a change to the underlying aircraft movement, the Customer’s sole remedy is a refund of the amount paid for that flight. Anona will use reasonable efforts to source an alternative but does not guarantee a replacement at the same price. Any specific conditions stated in the Flight Contract apply.

18. Force Majeure

  1. 18.1

Neither Anona nor, to the extent applicable, the Carrier is liable for failure, delay or disruption caused by events beyond its reasonable control, including severe weather, natural disasters, volcanic ash, war, terrorism, civil unrest, strikes and industrial action, air traffic control restrictions, airport closures, government action, sanctions, epidemics, security events, technical safety events and other circumstances that could not reasonably have been avoided.

  2. 18.2

Refunds and additional costs arising from a force majeure event are determined by the Flight Contract, the Carrier’s terms and applicable law. Committed third-party costs that cannot be recovered may be deducted from any refund.

19. Liability

  1. 19.1

Anona is responsible for performing its brokerage services with reasonable care and skill. Anona is not the air carrier and does not assume the Carrier’s obligations or liabilities for the operation of the Aircraft or carriage by air.

  2. 19.2

Liability for death, personal injury, damage to or loss of baggage, and delay arising from carriage by air is governed by applicable law and the Carrier’s Conditions of Carriage, including the Montreal Convention 1999 and applicable EU and EEA regulations. Claims of this kind shall be directed to the Carrier.

  3. 19.3

To the fullest extent permitted by law, Anona is not liable for indirect, consequential or purely economic loss, including loss of profit, business, opportunity, contracts, accommodation, onward travel or other consequential expense.

  4. 19.4

To the fullest extent permitted by law, Anona’s total aggregate liability arising from or in connection with a Charter is limited to the Charter Price paid by the Customer for the affected Charter.

  5. 19.5

The limitations in this clause do not apply to loss caused by Anona’s gross negligence or wilful misconduct, or to liability that cannot lawfully be excluded or limited.

  6. 19.6

The Customer is recommended to obtain appropriate travel, cancellation and medical insurance for all Passengers.

20. Customer Responsibility and Indemnity

  1. 20.1

The Customer shall indemnify Anona against losses, costs, fines, claims and liabilities, including reasonable legal costs, incurred by Anona or the Carrier as a direct result of the Customer’s or a Passenger’s breach of the Flight Contract or these Terms, unlawful conduct, damage to the Aircraft, carriage of prohibited items, or failure to comply with applicable travel, customs, immigration or pet requirements, except to the extent caused by the fault of Anona or the Carrier.

21. Compliance, Sanctions and Anti-Money Laundering

  1. 21.1

The Customer warrants that neither the Customer, its beneficial owners nor any Passenger is subject to sanctions imposed by the United Nations, the European Union, Norway, the United Kingdom or the United States, and that the Charter will not be used for any unlawful purpose.

  2. 21.2

Anona may at any time request identification and information about the Customer, its beneficial owners, the Passengers and the source of funds, in order to comply with applicable law and its internal policies. Anona may refuse or suspend a booking until satisfactory information is provided.

  3. 21.3

Anona may cancel a Charter with immediate effect if it reasonably believes that performance would breach applicable sanctions or other laws. Where this results from a breach of the Customer’s warranty in clause 21.1 or a failure to provide information under clause 21.2, the Charter is treated as cancelled by the Customer. Refunds are subject to any restrictions under applicable sanctions law.

22. Complaints and Claims

  1. 22.1

Complaints concerning Anona’s services shall be submitted in writing to Anona without undue delay, and no later than thirty (30) days after the Charter or the scheduled date of the Charter. Complaints submitted later may be rejected where permitted by applicable law.

  2. 22.2

Claims relating to the carriage by air are subject to the time limits in the Carrier’s Conditions of Carriage and applicable international conventions. Anona will on request forward such claims to the Carrier and provide reasonable assistance.

  3. 22.3

The Customer may not withhold payment of undisputed amounts pending resolution of a complaint.

23. Consumer Customers

  1. 23.1

If the Customer is a Consumer, mandatory consumer protection law prevails over these Terms. Clauses that limit Anona’s liability, pass on cost increases, set time limits for complaints or determine the place of jurisdiction apply only to the extent permitted by such law.

  2. 23.2

Under the Norwegian Cancellation Act (angrerettloven), the statutory right of withdrawal does not apply to passenger transport services. Cancellation by a Consumer is governed by clause 9.

  3. 23.3

Anona does not sell package travel or linked travel arrangements unless expressly stated in the Flight Contract. If Anona arranges a combination of travel services that constitutes package travel under the Norwegian Package Travel Act (pakkereiseloven), that Act applies to those services.

24. Data Protection

  1. 24.1

Anona processes personal data about the Customer and Passengers in accordance with the General Data Protection Regulation (GDPR) and the Norwegian Personal Data Act.

  2. 24.2

Personal data, including passport and identity details, is shared with the Carrier, handling agents, airports, authorities and other service providers where necessary to arrange and perform the Charter, to comply with legal obligations, or to protect aviation safety and security. This may include transfer to countries outside the EEA where required by the itinerary.

  3. 24.3

The Customer confirms that it is authorised to provide the personal data of all Passengers and that the Passengers have been informed of this processing. Further information is available in Anona’s privacy notice or on request.

25. Confidentiality

  1. 25.1

Anona treats the identity of the Customer and Passengers and the details of the Charter as confidential and does not disclose them except as required to arrange and perform the Charter, to comply with law, or with the Customer’s consent.

  2. 25.2

The Customer shall treat the prices and commercial terms in quotes and Flight Contracts as confidential.

26. Notices and Communications

  1. 26.1

Operational and contractual notices may be given by email or other written electronic communication to the contact details provided by the Customer. A notice sent by email is deemed received when sent, unless the sender receives notice of non-delivery.

  2. 26.2

The Customer is responsible for keeping its contact details current and for ensuring that urgent operational messages can be received before and during the Charter.

27. Assignment

  1. 27.1

The Customer may not assign or transfer its rights or obligations under the Flight Contract without Anona’s prior written consent. Anona may use subcontractors and service providers in the performance of its services.

28. Entire Agreement, Severability and Waiver

  1. 28.1

The Flight Contract, these Terms and the applicable Carrier terms constitute the entire agreement relating to the Charter and supersede all prior discussions, quotes and communications concerning that booking.

  2. 28.2

If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force, and the invalid provision shall be replaced by a valid provision that comes as close as possible to its original purpose.

  3. 28.3

A failure or delay in exercising any right does not constitute a waiver of that right.

29. Amendments and Language

  1. 29.1

Anona may amend these Terms from time to time. The version in force at the time the Flight Contract is issued applies to that Charter.

  2. 29.2

These Terms are drafted in English. If they are translated into another language, the English version prevails.

30. Governing Law and Jurisdiction

  1. 30.1

These Terms, the Flight Contract and Anona’s brokerage services are governed by Norwegian law, excluding its choice of law rules.

  2. 30.2

Any dispute arising from or relating to Anona’s services shall be subject to the exclusive jurisdiction of the Norwegian courts, with Oslo District Court (Oslo tingrett) as the agreed venue. Consumers may also bring proceedings at their place of residence where mandatory law so provides.

  3. 30.3

The Carrier’s own terms may provide for separate governing law or jurisdiction for claims relating to carriage by air.
